1. Information We Collect
We may collect the following types of information:
School and Contact Information
School name, staff contact name, staff role, email address, phone number, school address, event details, scheduling information, and service requests.
Student and Class Information
Student name, grade, classroom, teacher, homeroom, school, student ID, or other school-provided identifying information when needed for picture day, school deliverables, yearbook files, ID cards, proofing, or order fulfillment.
Parent/Guardian and Customer Information
Parent or guardian name, email address, phone number, shipping address, billing information, order history, selected images, selected packages, background choices, pose selections, and customer support communications.
Photographs and Image Information
Individual portraits, class photos, group photos, graduation photos, event photos, proof images, retouched images, and related image files created as part of our photography services.
Order and Payment Information
Order number, package selection, product selection, payment status, shipping information, delivery information, and transaction-related records. Payment card information may be processed by third-party payment processors and may not be stored directly by us.
Website and Technical Information
IP address, browser type, device information, website usage information, cookies, analytics data, security logs, and information submitted through website forms.
SMS/MMS Information
Mobile phone number, SMS/MMS opt-in status, the date and method of consent, message delivery information, opt-out requests, and communication history related to school photography services.
2. How We Use Information
We may use personal information to:
- Schedule and coordinate school photography services.
- Photograph students, staff, classes, graduates, teams, and school events.
- Match student names and class information to photographs.
- Create and provide access-controlled proofing galleries.
- Provide authorized yearbook images, ID images, class composites, staff photos, and other school-approved files.
- Send proof, order, shipping, delivery, and customer-support notices.
- Process and fulfill photo orders and respond to inquiries.
- Maintain records and comply with legal or contractual obligations.
- Protect and improve our website, galleries, systems, services, and customer experience.
3. SMS/MMS Communications
The AMC PHOTO School Photography Alerts program provides transactional SMS/MMS messages related to school photography services. Messages may include picture-day scheduling information, proof notifications, proof preview images, QR codes, gallery links, passwords, order confirmations, order status updates, delivery updates, and customer support messages.
We send SMS/MMS messages only after the recipient provides the consent required for that message program. SMS consent is requested separately from acceptance of general terms and is not a condition of purchasing products or services. Providing a phone number without an express SMS opt-in does not by itself enroll a person in recurring messages. We retain consent records as reasonably necessary to document the date and method of opt-in and to honor opt-out requests.
Message frequency varies based on picture-day, proof, order, delivery, and support activity. Message and data rates may apply. Messages may be sent using an automated messaging system.
Reply STOP to unsubscribe at any time. Reply HELP for help, visit Customer Support, email amcnyusa@gmail.com, or call 718-830-9050. After an opt-out, we may send one confirmation message and will not send further messages for that program unless the recipient provides new consent.
Consent for transactional messages does not authorize promotional messages. Any promotional SMS/MMS program, if offered, will require separate consent where required.
Wireless carriers are not liable for delayed or undelivered messages.
4. Mobile Information and Consent Are Not Shared for Marketing
We do not sell, rent, share, transfer, or disclose mobile phone numbers, text-messaging originator opt-in data, or SMS/MMS consent information to third parties or affiliates for their marketing or promotional purposes.
Mobile information may be provided only to service providers that help us deliver messages requested by the recipient, such as telecommunications and messaging platform providers, and only as needed to provide that service. Those providers may not use the information for their own marketing or promotional purposes. This SMS-specific restriction applies notwithstanding anything else in this Privacy Policy.
5. How We Disclose Information
We do not sell or rent personal information. We may disclose information only as reasonably necessary:
Schools and Authorized School Representatives
We may provide student images, class information, yearbook files, ID photos, staff photos, class photos, and related deliverables to the school or its authorized representatives as permitted by the applicable school agreement.
Parents, Guardians, and Customers
We may provide authorized users with access to proofing galleries, selected images, order information, and purchased products.
Service Providers
We may use providers for website hosting, proofing galleries, email delivery, SMS/MMS delivery (including messaging platforms such as Twilio), payment processing, printing, photo production, shipping, order management, customer support, security, and data storage. They may access information only as needed to perform services for us and subject to applicable contractual and legal safeguards. Mobile opt-in data remains subject to Section 4.
Legal, Safety, and Compliance
We may disclose information when required by law, legal process, or government request, or when reasonably necessary to protect our rights, customers, students, schools, employees, systems, or services. Where student PII is involved, we will follow applicable notice and contractual requirements unless notice is legally prohibited.
6. Student Information and NYC Public Schools Requirements
Student information and photographs are used only for school photography services, school-authorized deliverables, access-controlled proofing, parent or guardian ordering, customer support, and related purposes permitted by the applicable school agreement.
We do not sell student personal information, and we do not use student personal information or student photographs for unrelated advertising or third-party marketing.
When we receive student personally identifiable information ("student PII") from New York City Public Schools ("NYCPS," formerly referred to as the NYC DOE) under a written agreement, we handle that information in accordance with the agreement and applicable requirements, which may include FERPA, New York Education Law ยง 2-d, Part 121 of the Regulations of the New York Commissioner of Education, Chancellor's Regulation A-820, NYCPS Data Privacy and Security Policies, and the NYCPS Parent's Bill of Rights for Data Privacy and Security. As applicable, we:
- Collect and use only the student PII needed for the authorized service.
- Limit access to personnel and authorized providers with a legitimate need to perform the contracted service.
- Do not use student PII for marketing, advertising, or another unauthorized purpose.
- Require authorized subcontractors receiving student PII to accept appropriate written privacy and security obligations.
- Use reasonable administrative, technical, and physical safeguards for student PII in storage and transit.
- Address suspected unauthorized access or disclosure and provide required notices.
- Return, transfer, securely delete, or destroy student PII when directed or when the agreement ends, subject to legal retention requirements.
Requests to inspect, correct, challenge, or delete education-record information received from NYCPS may need to be submitted through the student's school or NYCPS so the requester's identity and authority can be verified. Parents and guardians may review the NYCPS Parent's Bill of Rights for Data Privacy and Security.
References on our website to NYCPS, the NYC DOE, or a vendor number describe contracting or vendor information only. They do not imply NYCPS endorsement or authorization to provide services to every school. A school-specific contract or written authorization controls where required.
Schools are responsible for providing or obtaining any authorizations or consents required for photography services and school-approved deliverables. Parents or guardians with questions about participation should contact their school directly.
7. Children and Direct Website Use
Our public website and ordering services are intended for school representatives, parents, guardians, and other adults. We do not knowingly ask a child under 13 to independently submit personal information through the public website. A parent, guardian, or authorized school representative should submit information and place orders for a child. If you believe a child submitted personal information directly without appropriate authorization, contact us so we can review the request.
8. Photo Proofs, Galleries, and QR Codes
Photo proofs and galleries may be protected by passwords, access codes, QR codes, private links, or other access controls. Customers are responsible for keeping gallery links, QR codes, passwords, and order information secure and should not share them with unauthorized persons. Proof images may be unedited and may be professionally edited before final printing or delivery.
9. Cookies and Website Analytics
Our website may use cookies, analytics tools, or similar technologies to operate the website, understand website traffic, improve user experience, and maintain security. You may adjust cookie settings through your browser. Some features may not function properly if cookies are disabled.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These may include encrypted connections, access-controlled galleries, restricted personnel access, authentication controls, monitoring, and secure service providers. No online service or electronic storage system is completely secure, and we cannot guarantee absolute security.
11. Data Retention
We retain personal information and photographs only as long as reasonably necessary to provide services, complete and deliver orders, support reorders, provide school deliverables, resolve support issues, document messaging consent, comply with school agreements and legal obligations, maintain records, and protect our rights. When information is no longer needed, we may delete, archive, de-identify, return, or securely destroy it. A school agreement may require a shorter retention period or specific instructions for student PII.
12. Your Choices and Requests
You may contact us to request access to, correction of, or deletion of personal information, subject to identity verification, school requirements, order fulfillment needs, contractual obligations, legal requirements, and business record requirements.
Parents or guardians may contact us or the school regarding student photos, proof access, or photo-removal requests. Requests concerning NYCPS education records may be referred to the school or NYCPS for verification and handling.
You may opt out of SMS/MMS messages by replying STOP.
13. Links to Other Websites
Our website, emails, text messages, proofing pages, or QR codes may contain links to third-party websites or services. We are not responsible for their privacy practices, security, or content.
14. Updates to This Privacy Policy
We may update this Privacy Policy from time to time. Updates will be posted on this page with a new effective date. Continued use of our website or services after updates are posted means you acknowledge the updated Privacy Policy.
